These Terms of Service (“Terms”) govern your access to and use of snowball.capital (the “Site”), operated by Snowball Capital Sdn Bhd (“Snowball Capital”, “we”, “us”, or “our”), an investment holding company based in Penang, Malaysia. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Important — third-party websites. The Site links to our portfolio companies and other third-party websites. Those sites are operated independently and have their own terms of use and privacy policies. When you click through to any linked website, that website’s respective terms govern your use of it. We do not control and are not responsible for third-party sites.
1. About the Site
The Site is an informational presence for Snowball Capital describing who we are, what we hold, and how to reach us. It also provides a sign-in area for limited partners (the “LP portal”).
2. Not an offer or financial advice
Nothing on the Site constitutes an offer, solicitation, invitation, or recommendation to buy, sell, or subscribe for any security, fund interest, or financial product, nor does it constitute investment, financial, legal, tax, or other professional advice. Any reference to holdings, portfolio companies, or investments is for information only and does not imply any current recommendation. Past performance is not indicative of future results. You should obtain independent professional advice before making any decision.
3. Eligibility & LP portal
The LP portal is restricted to authorised limited partners and invited users. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@snowball.capital of any unauthorised use. We may suspend or terminate access at our discretion.
4. Acceptable use
You agree not to:
- use the Site for any unlawful purpose or in breach of these Terms;
- attempt to gain unauthorised access to any part of the Site or its systems;
- interfere with, disrupt, or impose an unreasonable load on the Site;
- scrape, harvest, or copy content except as permitted below;
- misrepresent your identity or affiliation.
5. Intellectual property
The Site and its content — including text, design, logos, and the Snowball Capital name — are owned by or licensed to us and protected by applicable intellectual property laws. You may view and print content for personal, non-commercial reference. All other use requires our prior written consent. Third-party names, logos, and trademarks shown on the Site belong to their respective owners.
6. Third-party links & portfolio websites
The Site contains links to portfolio companies and other external websites. We provide these links for convenience only; they do not imply endorsement. We have no control over, and accept no responsibility for, the content, products, services, terms, or privacy practices of any third-party website. Your use of any linked website is governed by that website’s respective terms and privacy policy, which you should review.
7. Disclaimer of warranties
The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by Malaysian law, Snowball Capital and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of, or inability to use, the Site or any linked website.
9. Indemnity
You agree to indemnify and hold harmless Snowball Capital against any claims, losses, liabilities, and expenses arising from your breach of these Terms or your misuse of the Site.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we handle personal data in accordance with Malaysia’s Personal Data Protection Act 2010 (PDPA).
11. Changes to the Site & Terms
We may modify or discontinue the Site, and update these Terms, at any time. The “Last updated” date reflects the latest revision. Continued use after changes constitutes acceptance of the revised Terms.
12. Governing law & jurisdiction
These Terms are governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising out of or in connection with the Site or these Terms.
13. Language
These Terms are provided in English. In the event of any inconsistency with a translated version, the English version prevails.
